Chapter 7 Bankruptcy
Those who have a high amount of bills and little or no hope of paying them back in a reasonable amount of time often opt for Chapter 7 bankruptcy. For those that qualify, Chapter 7 can eliminate most types of unsecured debt. When you file, an automatic stay goes into effect halting collection activity from most creditors. You are also allowed to exempt a portion of your personal property (such as a certain amount of equity in your home, vehicle and other personal items) from being liquidated to pay off your debts, up to the maximum allowed by the state of Illinois.
Chapter 13 Bankruptcy
Chapter 13 is essentially a court-approved debt consolidation plan. This option is suitable for those with steady income that need more time and/or a lower monthly payment in order to pay back their debts. Using Chapter 13 bankruptcy, debtors are able to propose a plan to repay their debts over the course of three to five years. During the process, it is often possible to significantly reduce interest on debts and come up with a lower and more manageable overall monthly payment.
The Bankruptcy Reform and Consumer Protection Act (BAPCPA) made widespread changes to the law and was intended to help protect creditors and reduce fraud. These changes placed restrictions on qualifications for filing Chapter 7 bankruptcy. In some cases, individuals are forced to opt for Chapter 13 (reorganization) if they do not meet the requirements for a Chapter 7 filing.
